JUDGMENT 1. This writ petition has been filed by the petitioner seeking a direction to the respondents to consider the earlier services of the petitioner rendered on the post of Teacher Gr. III (Level-I), Zila Parishad, Jodhpur as he has joined at Zila Parishad, Bhilwara as Teacher Gr.III (Level-I) pursuant to the subsequent recruitment made. 2. Though none is present for the petitioner, learned counsel for the respondents submits that the issue raised in the present writ petition is squarely covered by judgment of this Court in the case of Ashok Kumar Sharma v. State of Rajasthan & Ors.: S.B. Civil Writ Petition No. 15411/2018 & other connected matters, decided on 14.3.2019, wherein, this Court after hearing the parties in a similar nature writ petition directed as under:- "In view of the above factual and legal position, merely on account of petitioners have tendered resignation, they cannot be deprived of the benefit of counting of their past services. In view of the above discussion, the writ petitions filed by the petitioners are allowed. The petitioners would be entitled to same relief as granted in the case of Dhanraj Meena (supra) / Virender Singh (supra) as per Circular dated 9.8.2018 (Annex.R/1). Needful may be done by the respondents within a period of two months from today. No order as to costs." 3. In view of the above fact situation, wherein, the case of the petitioner is squarely covered by judgment in Ashok Kumar Sharma (supra), the writ petition filed by the petitioner is also allowed with similar directions as given in the case of Ashok Kumar Sharma (supra).
