JUDGMENT Ramendra Jain, J. (Oral) - Through this revision, petitioners-accused have laid challenge to the order dated 27.07.2017 of the trial Court charge-sheeting them under Section 307 and 326 IPC, apart from other Sections. 2. Learned counsel for the petitioners inter alia contends that respondent No. 2-complainant filed the complaint after 6 months of the occurrence, wherein, after summoning, learned counsel for the petitioners raised submission on the point of charge, but the trial Court, without dealing with the same, illegally charge-sheeted them under Sections 307 and 326 IPC, apart from other sections, ignoring the fact that there was no medical opinion on record that any of the complainant/injured had received any grievous injury, declaring dangerous to life. 3. On the other hand, learned State counsel assisted by learned counsel for respondent No. 2 vehemently refuted the submissions of learned counsel for the petitioners. 4. Having given thoughtful consideration to the rival submissions, the petitioners are relegated to the trial Court, to raise all the pleas which they have raised in the instant revision. 5. In the meantime, order dated 27.07.2017 shall remain in abeyance. 6. Parties are directed to appear before the trial Court on 30.04.2019.
