JUDGMENT Ajay Tewari, J. (Oral) - This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.118 dated 10.12.2015, under Section 22 of the NDPS Act, 1985, Police Station Badhni Kalan, District Moga. 2. Counsel for the petitioner has argued that this is a case where recovery is only of 50 grams intoxicant powder and petitioner is in custody for almost 9 months. 3. Senior Deputy Advocate General, Punjab, on instructions from HC Iqbal Singh, points out that the petitioner had been released on bail and he abscond and could be arrested after one year. He states that there are nine witnesses and all the witnesses are official witnesses and no evidence has been led till date. 4. Keeping in view the entire conspectus of facts and the period of incarceration already suffered by the petitioner, without going into the merits of the case, I deem it appropriate to grant regular bail to the petitioner. 5. Ordered accordingly. 6. Bail to the satisfaction of the concerned CJM/Illaqa Magistrate. Learned CJM/Illaqa Magistrate shall be just in demanding heavy surety keeping in view the proximity of the petitioner. 7. Petition stands allowed. 8. Since the main case has been decided, the pending criminal msc. Application, if any, also stands disposed of.
