ORDER : Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. 2. During the pendency of the writ petition the respondents have taken decision to terminate the services of the petitioner in purported exercise of power under Rule 15 ‘ t ’ of Bihar Panchayat Prarambhik Shikshak (Niyojan Evam Seva Shart) Niyamawali, 2012. Rule 15 ‘ N ’ deals with the disciplinary action which requires compliance of natural justice. Admittedly no procedure was followed while taking decision against this petitioner and as such the action of the respondents is in teeth of Rule 15 ‘ N ’ and it cannot sustain. There is no concept of automatic termination on account of unauthorized absence. Considering the fact that the Rule provides for compliance of natural justice in taking disciplinary action, any action of the respondents including termination of the petitioner in teeth of Rule 15 ‘Chha’ is unsustainable.
