Judgment Mr. Ajay Tewari, J. (Oral):- This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.148 dated 05.06.2018, under Section 15 of the NDPS Act, 1985, Police Station Kotwali Patiala. 2. The allegations are that husband and wife were going in a car and 55 kgs. poppy husk was recovered from them. 3. Counsel for the petitioner has argued that the petitioner has been punished for no fault on her part. 4. Senior Deputy Advocate General, Punjab, has filed custody certificate in Court today which is taken on record. He states that the recovery of the puppy husk is of commercial quantity. He has accepted the fact that husband of the petitioner is in jail. 5. As per the custody certificate the petitioner remained in custody for 7 months and 16 days as on 25.01.2019. 6. Keeping in view the entire conspectus of facts and the period of incarceration already suffered by the petitioner, without going into the merits of the case, I deem it appropriate to grant regular bail to the petitioner. 7. Ordered accordingly. 8. Bail to the satisfaction of the concerned CJM/Illaqa Magistrate. Petition stands allowed. 9. Since the main case has been decided, the pending criminal msc. Application, if any, also stands disposed of.
