ORDER : Being aggrieved by the order dated 9.7.2018 (Annexure-P/3) confirmed in appeal vide order dated 13.9.2018 directing externment of the petitioner in exercising the power under Section 5 (b) of the M.P. Rajya Surakasha Adhiniyam, 1990 (hereinafter referred to as ‘the Addhiniyam’), the present petition has been preferred. 2. In view of the foregoing, the order of externment passed by the District Magistrate has been confirmed. 5. Learned counsel for the petitioner has placed reliance on the provision of Section 5 of the Adhiniyam, which reads as under:- ''5. Removal of persons about to commit offence– Whenever it appears to the District Magistrate – (a) that the movements or acts of any person are causing or calculated to cause alarm, danger or harm to person or property; or (b) that there are reasonably grounds for believing that such person is engaged or is about to be engaged in the commission of an offence involving force or violence or an offence punishable under Chapter XII, XVI or XVII or under Section 506 or 509 of the Indian Penal Code, 1860 (45 of 186)) or in the abetment of any such offence, and when in the opinion of the District Magistrate witnesses are not willing to come forward to give evidence in public against such person by reason of apprehension on their part as regards the safety of their person or property; or (c) that an outbreak of epidemic disease is likely to result from the continued residence of an immigrant; the District Magistrate, may by an order in writing duly served on him or by beat of drum or otherwise as the District Magistrate thinks fit, direct such person or immigrant – (a) so as to conduct himself as shall deem necessary in order to prevent violence and alarm or the outbreak or spread of such disease; or (b) to remove himself outside the district or any part thereof or such area and any district or districts or any part thereof, contiguous thereto by such route within such time as the District Magistrate may specify and not to enter or return to the said district or part thereof or such area and such contiguous districts, or part thereof, as the case may be, from which he was directed to remove himself.'' 6. In support of the said contention, a reliance has been placed in the judgment passed by this Court in W.P. No.6185/2010 (Balbir @ Bunty Vs. State of M.P. and others) decided on 27.08.2010. Reference has been made on the decision rendered by the Division Bench in case of Ashok Kumar Patel Vs. State of M.P. 2009 (4) MPHT 263 (DB). In support of the said contention, a reliance has been placed in the judgment passed by this Court in W.P. No.6185/2010 (Balbir @ Bunty Vs. State of M.P. and others) decided on 27.08.2010. Reference has been made on the decision rendered by the Division Bench in case of Ashok Kumar Patel Vs. State of M.P. 2009 (4) MPHT 263 (DB). The reliance has also been placed in a recent judgment of this Court in W.P. No.9297/2017 (Anek @ Anil Nageshwar VS. State of Madhya Pradesh and four others) decided on 08.08.2017, wherein all the relevant judgments of this Court as well as the Supreme Court has been considered and order impugned was set aside. 7. In view of the foregoing submissions, it is urged that the order of externment of the petitioner passed by the Competent Authority and confirmed by the Appellate Authority may be ordered to be set aside. 8. On the other hand, learned Panel Lawyer for the State submits that number of cases have been registered against the petitioner and also in previous election, he has been taken for externment against which the proceeding is still pending. The Competent Authority after going through the registration of various criminal cases has rightly taken the action against the petitioner, therefore, no interference is warranted in the present case. 9. On being asked by this Court, whether the offence as referred in the order impugned would fall in any offence described in Section 5(b) of the Adhiniyam, learned Panel Lawyer states that offence registered against the petitioner do not fall either in Chapter XII or in Chapter XVI, XVII or Sections 506 and 509 of the Indian Penal Code. 10. Considering the aforesaid and looking to the facts that no material is available, thereby reasonable ground is available to believe that the person is engaged or is about to be engaged in commission of the offence as specified in section 5(b) of the Adhiniyam. Nothing is available on record that on account of the activities of a person, who is externee, the witnesses amongst public are not coming forth to depose in the criminal cases against him. In absence of such material, the order of externment passed by the District Magistrate confirmed in appeal are wholly unjustified, hence it is hereby set aside. 11. Accordingly, this petition succeeds and is allowed.
