JUDGMENT : 1. Heard the learned counsel for the parties. 2. In this writ application the petitioner has prayed for issuance of an appropriate writ in the nature of mandamus commanding upon the respondents particularly Deputy Commissioner Godda to convene a meeting and pass appropriate order in the District Level Appointment Committee to reinstate the petitioner in service in view of the direction issued by the Director Jharkhand Education Project Council. 3. It is stated that the petitioner was selected and was appointed on contract basis for the Kasturba Gandhi Residential Girls School vide letter no. 819 dated 1.12.2006 issued under the signature of the D.S.E cum District Programme Officer, Godda. Petitioner was thereafter posted as Watchman in Kasturba Gandhi Residential School Godda. It is stated that the petitioner was threatened of dire consequences and abusive language was issued by the Warden against the petitioner against which the petitioner made a complaint on 31 st July, 2007 to the D.S.E Godda and for this reason a criminal case was filed against the petitioner. 4. On that ground, service of the petitioner was terminated videorder dated 6.5.2008 by the D.S.E. 5. Mr. Krishna Murari, the learned counsel for the respondent no. 3 and 4 submits that the petitioner has not challenged the termination order. He further submits that the petitioner is working on basis of contractual basis and he has no right to renew his contract. He also submits that in view of the reasons, this writ petition is fit to be dismissed. 6. Having heard the learned counsel for the parties, this court finds that the petitioner has not challenged the termination order and service of the petitioner was contractual in nature. No case is made out to interfere in the writ petition. Accordingly this writ petition is dismissed.
