JUDGMENT Sanjay K Agrawal, J. - The second appeal filed by the appellant / defendant was dismissed on 22-7-2019. Thereafter, on 2-9-2019, this review petition has been filed merely on the ground that application under Order 41 Rule 27 of the CPC has not been considered at the time of final hearing of the second appeal. 2. Mr. H.V. Sharma, learned counsel appearing for the petitioner herein / defendant, submits that the application under Order 41 Rule 27 of the CPC was not decided at the time of final hearing. 3. The judgment was dictated in the open court on 22-7-2019 and the second appeal was dismissed. The application under Order 41 Rule 27 of the CPC was not brought to the notice of court at the time of hearing of the appeal. Even otherwise, by the application under Order 41 Rule 27 of the CPC, two documents viz., copy of settlement record (missail bandobast) of the year 1928-29 and Form B-1 adhikaar abhilekh, have been filed. It appears that these documents were filed in the 2018, whereas the second appeal was pending before this Court since 27-1-2005 and there was no plausible reason for delay in filing those documents and why the same were not filed before the first appellate Court. These two documents relate to question of fact recorded by the two Courts below regarding partition / nature of property between the parties. 4. In that view of the matter, I do not find any merit in this review petition. The petition deserves to be and is accordingly dismissed.
