JUDGMENT Ajay Tewari, J. (Oral) - This order shall dispose of the aforesaid petitions as they arise from the same FIR. 2. The petitioners seek grant of regular bail in case FIR No. 120, dated 20.7.2017, registered under Sections 21, 61, 85 of the NDPS Act, at Police Station Sadar Patti, District Tarn Taran. 3. Counsel for the petitioners have argued that that 35 grams of heroin was recovered from Kartar Singh and the petitioners have been inculpated on the basis of his disclosure statement. The other charge which has been framed against them is that another recovery of 1 kg 20 grams of heroin was owned by the petitioners. The petitioners have now been in custody for one year and eight months and out of 23 witnesses not even a single witness has been examined. 4. Learned DAG Punjab, on instructions from ASI Sukhwinder Singh, has accepted these facts. She, however, states that some other cases are also registered against the petitioners. 5. Be that as it may, without commenting upon the merits of the case, and keeping in view the period of custody already suffered by the petitioners, I do not deem it appropriate to deny the concession of regular bail to the petitioners. 6. Bail to the satisfaction of the trial Court/Duty Magistrate. 7. Petitions stand disposed of. 8. Since the main cases have been decided, the pending C.Ms, if any, also stand disposed of.
