ORDER Heard learned counsel for the petitioners and the counsel appearing on behalf of the State. 2. The grievance of the petitioners in the present writ application is non consideration of his case for grant of promotion. 3. Learned counsel for the petitioners submits that similarly circumstanced others have been granted benefit of promotion. 4. In the counter affidavit statement has been made that the respondents to take appropriate decision granting promotion to the petitioners in the next meeting of the Departmental Promotion Committee. The statement made in paragraph no.11 of the counter affidavit is quoted below: – “11. That so far as claim raised by the petitioners in this case is concerned it is humbly stated that in pursuance of filing of the writ application, the claim of the petitioners has been examined and it has been found that the claim of the petitioners appears to be bonafide, as they are entitled to get promotion in trained graduate scale and as such, they shall be given promotion from their respective date of entitlement by placing their cases in the next meeting of the District Primary Teachers Promotion Committee, Madhubani and consequently, their claim shall be redressed.” 5. In view of the above, the writ petition is disposed of with a direction to the respondent District Programme Officer, Madhubani to take that appropriate decision granting promotion to the petitioners is taken by the Departmental Promotion Committee within a period of 45 days from the date of receipt/ production of copy of this order otherwise petitioners would be entitled to the benefit of promotion with all consequential benefits after expiry of time. 6. With the aforesaid, the present writ application stands disposed of.
