JUDGMENT 1. Heard learned counsel for the parties and also perused the material available on record. 2. The petitioners have been arrested in FIR No. 23/2018 of Police Station Rajgarh, Distt. Churu for the offences punishable under Sections 147, 148, 449, 452, 326, 307, 302 120B read with Section 149 IPC. They have preferred these bail applications under Section 439 Cr.P.C. 3. At the outset, learned counsel for the petitioners does not want to press the bail application preferred on behalf of petitioner - Naveen @ Kalu S/o Jagpal Singh. 4. Hence, the bail application preferred on behalf of petitioner - Naveen @ Kalu S/o Jagpal Singh is dismissed as not pressed. 5. So far as petitioner - Vipin S/o Ramnivas is concerned, it submitted by learned counsel for the petitioner that from a bare perusal of the charge-sheet filed by the police, it is clear that sufficient evidence regarding his involvement in commission of crime has not been collected by the police. It is argued that the police have implicated petitioner - Vipin S/o Ramnivas only on the basis of doubt. It is further argued that co-accused persons namely Banshi Lal, Balkesh and Sandeep have already been enlarged on bail, against whom, the police have also failed to collect evidence regarding their involvement in commission of crime. 6. Per contra, learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed the bail application. 7. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to petitioner - Vipin S/o Ramnivas under Section 439 Cr.P.C. 8. Accordingly, the bail application preferred on behalf of petitioner - Vipin S/o Ramnivas under Section 439 Cr.P.C. is allowed and it is directed that he shall be released on bail in connection with FIR No. 23/2018 of Police Station Rajgarh, Distt. Churu provided he executes a personal bond in the sum of Rs. 50,000/- with two sound and solvent sureties of Rs. 25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
