JUDGMENT : Rajiv Joshi, J. 1. Heard Sri Rajendra Prasad, learned Counsel for the petitioner. The present writ petition has been filed challenging the orders dated 8.4.2008 as well as 13.7.2018 passed by the Deputy Director of Consolidation, Jhansi whereby the revision filed by the respondents was allowed and the restoration application filed against the said order by the petitioner was rejected. 2. From the perusal of the order dated 8.4.2008, indicates that the revision was decided on the basis of compromise between the parties and the orders passed by the Assistant Settlement Officer Consolidation as well as Consolidation Officer dated 29.12.2004 and 24.5.2003 were set aside. On the basis of compromise the name of one Kaliya daughter of Kharge was deleted from the record and in his place the name of Smt. Gango widow of Laxman has been recorded. Against the order passed by the Deputy Director of Consolidation dated 8.4.2008, the restoration application was filed by the petitioner on 1.6.2017 along with an application for condoning the delay. 3. In the meantime, Smt. Gango was died and an objection was filed by Shyam Kushwaha, the adopted son of Laxman. 4. The petitioner filed the restoration application on the ground that the petitioner have no knowledge about the said order and when the respondents came at the spot for taking possession, he came to know about the said order thereafter, the restoration application was filed. The restoration application filed by the petitioner was rejected by the Deputy Director of Consolidation on the ground of limitation. Finding has also recorded that the registered notice was issued to the father of petitioner which was served. 5. I do not find any illegality or infirmity in the order passed by the Deputy Director of Consolidation and finding has been recorded on the basis of evidence available on record. The inordinate delay has not rightly been condoned by the Deputy Director of Consolidation, Jhansi, by the impugned order. 7. The writ petition lacks merit and is, accordingly, dismissed. No order as to costs.
