JUDGMENT : Hitesh Kumar Sarma, J. 1. This is an application, filed under Section 439 Cr.P.C. praying for bail of the accused- petitioner, namely, Sanjib Kr. Barua, in connection with Satgaon PS Case No. 293/2019 under Sections 436/427/506/34 IPC. 2. Heard Mr. G. Choudhury, learned counsel for the accused-petitioner as well as Ms. S.H. Bora, learned Additional Public Prosecutor for the state respondent. 3. Perused the petition as well as the annexure furnished therewith. 4. Considering the nature of the allegation as appears from the materials in the case diary and the mischief allegedly caused taken together with the fact of custodial detention of the accused-petitioner for 20 days, this court is of the view that further custodial detention of the accused-petitioner, in the interest of investigation of the case, is not necessary, and accordingly, his prayer for bail is allowed. 5. The accused-petitioner is granted bail on his furnishing bail bond of Rs. 10,000/- with one suitable surety of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati, on the following conditions: (1) The accused-petitioner shall not leave the territorial jurisdiction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati, without prior written permission from the said learned court. (2) The accused-petitioner shall not hamper with the investigation, or tamper with the evidence of the case. (3) The accused-petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. 6. The petition stands disposed of accordingly.
