JUDGMENT Mr. Ajay Tewari, J. (Oral):- This is a petition for grant of anticipatory bail to the petitioner under Section 438 Cr.P.C. in case FIR No.84 dated 19.03.2019 registered under Section 7 of Prevention of Corruption Act, 1988 at Police Station Division No.8, District Ludhiana. 2. Learned counsel for the petitioner states that the main allegations are against the Avtar Singh and the only allegation against the petitioner is that he took the money from the complainant and handed over to Avtar Singh. There is not even an allegation that the petitioner knew about the alleged bribe. As per him in the video, the conversation is not properly audible. 3. These essential facts have been accepted by the learned Deputy Advocate General on instructions from ASI Ram Krishan. Though she has argued that there was no occasion for the petitioner to have taken the money also even to hand it over to Avtar Singh and therefore prays that the bail should not be granted. 4. In the circumstances, I do not deem it appropriate to deny the concession of anticipatory bail to the petitioner. Resultantly, the petition is allowed. In the event of arrest of the petitioner, he shall be released on bail to the satisfaction of the Investigating Officer subject to the conditions envisaged under Section 438(2) Cr.P.C. 5. The petitioner is directed to appear before the Investigating Officer on 29.04.2019 and on any other date as and when his presence is required. 6. Since the main case has been decided, the pending criminal miscellaneous application, if any, also stands disposed of.
