JUDGMENT : SANJAY KUMAR DWIVEDI, J. 1. Heard Mr. S. Mitra, learned counsel for the petitioner and Mr. Akash Deep, learned A.C. to S.C. IV and Mr. Ranjit Kumar, learned A.C. to G.A. Bihar and Mr. Sudarshan Shrivastava for the respondents. 2. The petitioner has preferred this writ petition for direction upon the respondents to give promotion to the petitioner to the post of Additional Superintendent of Police from 01.08.2001 or before 01.08.2001. 3. Learned counsel for the petitioner further submits that the petitioner was promoted to the post of Senior Deputy Superintendent of Police w.e.f. 15.11.2000. The petitioner was further promoted to Additional Superintendent of Police w.e.f 07.05.2004. As the juniors to the petitioner were promoted w.e.f. 07.03.1996. Thus the petitioner filed several representation in pursuance to that date of promotion i.e. 7.3.1996 which has also been accepted by the State of Jharkhand. Learned counsel for the petitioner submits that he has filed the representation before the authorities but no decision has been taken by the authorities. 4. Mr. Sudarshan Shrivastava, learned counsel appearing for the respondent nos. 9 & 10 submits that the pay slip of Rs. 10,000-15,200/- was issued in favour of the petitioner along with actual benefit from 01.04.97. He pointed out that the similarly situated cases have been considered by this Court. The matter may be remitted back to the authorities and the petitioner may be directed to file representation before the authorities. The authorities on the representation of the petitioner can take a decision and pass speaking order. 5. This Court directs the petitioner to file representation before the authorities and the authorities will pass speaking order within six weeks from the date of production of copy of this order and taking into account the observations made herein above. 6. With the aforesaid observations and directions the writ petition stands disposed of.
