Shivaji Pandey, J. – Heard learned counsel for the appellant and learned counsel for the State. 2. Learned counsel for the appellant submits that the case of the appellant is completely covered by the judgment and order dated 10.12.2018 passed in L.P.A. No. 1409 of 2017 (Raj Narain Singh and Ors. vs. The State of Bihar and Ors.), in which the Court has held that the teachers who have passed the examination in the second attempt cannot be deprived of the notional benefit as has been given to the teachers who have passed the examination in the first attempt. 3. In the present case, the appellant appeared in the examination but, was caught while cheating, he was expelled from the examination and in second attempt he has cleared the examination, so he is claiming that he should be given the relief as has been given to similarly situated person namely, Raj Narain Singh. 4. Let the respondent authorities consider the case of the appellant and take decision in terms of the judgment and order passed in L.P.A. No. 1409 of 2017 within a period of four months from the date of receipt/production of a copy of this order. 5. With the aforesaid observations and directions, this appeal is disposed of. Accordingly, the judgment and order of the learned Single Judge passed in C.W.J.C. No. 3967 of 2014 is hereby set aside. 6. It is clarified that we are not giving any direction for consideration of grant of monetary benefit to the appellant.
