JUDGMENT 1. The present bail application has been filed under Section 439 Cr.P.C. The petitioners have been arrested in connection with FIR No. 130/2019 Registered at Police Station Malviya Nagar, Jaipur for the offence(s) under Sections 420, 406, 409 and 120-B IPC. 2. Counsel for the petitioners submits that the petitioners have been falsely implicated in this matter. Counsel further submits that the petitioners are not named in the FIR. Counsel further submits that the petitioners being traders purchased certain begs of Methi (Fenugreek) from one Shri Hazari Lal Gupta and according to FIR, Hazari Lal Gupta illegally sold the Methi to the petitioner and misappropriated the goods of complainant No. 2 Ashutosh Kedawat. Counsel further submits that since the petitioners are trader of goods, they sold the same through GST invoice to Shri Balaji Traders of Bareli and the petitioners are in custody since 10.04.2019. 3. Learned Public Prosecutor has opposed the bail application. 4. Considering the contentions put-forth by the counsel for the petitioners and taking into account the facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to enlarge the petitioners on bail. 5. Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioners Sunil Goenka S/o Shri Dinesh Chandra Gupta and Pramod Kumar Mittal S/o Shri Bhagwan Lal Mittal shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
