ORDER 1. This is a transfer petition at the instance of the petitioner-wife seeking transfer of H.M.P.No.102 of 2014, titled as Satish Helonde vs. Smt. Ranu @ Chandrabhaga Helonde, pending in the Court of 8th JT, Civil Judge, Senior Division, Nagpur, Maharashtra, to the Family Court at Durg, Chhattisgarh. 2. The petitioner has sought transfer of the case mainly on the ground of financial difficulty and her inability to travel from Durg, Chhattisgarh to Nagpur, Maharashtra with her 3 years' old daughter, to attend the proceedings of the case filed by the respondent. 3. Notice of the transfer petition has been duly served upon the respondent, but neither he nor any one else has appeared on his behalf and no counter affidavit has been filed to oppose the prayer made by he petitioner. 4. In view of the hardships which will be faced by the petitioner in contesting the case at Nagpur, Maharashtra, we deem it proper to allow the transfer petition and transfer the aforesaid case from the Court of 8th JT, Civil Judge, Senior Division, Nagpur, Maharashtra, to the Family Court at Durg, Chhattisgarh, along with all records for its adjudication. Ordered accordingly.
