JUDGMENT : Per Sanjay Kumar Dwivedi, J.: 1. Heard Mr. Kaushik Sarkhel, learned counsel appearing for the petitioner and Mr. M.K. Sinha, learned Sr.S.C.II appearing for the respondents. 2. Pursuant to order dated 12.06.2019, the State has brought on record the dismissal order. 3. At the outset, learned counsel for the petitioner relying on the case of Tara Devi V. State of Jharkhand reported in 2013 Vol. III J.L.J.R. 1997, submits that the power of removal of the Anganwari Sevika is vested in the selection committee which alone can issue such recommendation order. He further submits that in view of the judgment of this Court, the impugned order cannot survive in the eye of law. 4. Although the post of Anganwari Sevika is not a civil post but looking into the judgment of this Court, the impugned order is quashed and the matter is remitted back to the selection committee who will pass appropriate order in terms of the law laid down in the case Tara Devi (Supra). 5. In terms of the above directions, the writ petition stands disposed of.
