JUDGMENT 1. Petitioner has preferred this Criminal Misc. Petition for quashing of order dated 08.01.2019, passed by Judicial Magistrate No. 6, Ajmer, vide which the Court has taken cognizance against the petitioner. 2. It is contended by counsel for the petitioner that the petitioner and complainant have entered into a compromise and complainant does not wish to pursue the complaint. 3. I have considered the contentions. 4. Statement of prosecutrix has been recorded by the Court under Section 164 Cr.P.C., wherein she has levelled allegation with regard to rape against the petitioner. In such cases, Court is bound to take cognizance and cannot go by the version of the prosecutrix which is given on a later date, that she does not wish to pursue the complaint, I am not inclined to entertain the Criminal Misc. Petition. 5. The Criminal Misc. Petition is, accordingly, dismissed. Stay application also stands disposed.
