JUDGMENT : Ajai Lamba, J. Sri Shibaji Das seeks bail under Section 438 of the Code of Criminal Procedure, 1973 in Dhubri Sadar Police Station Case No.1819/2019 under Section 14/15 of Assam Game and Betting Act. 2. As per allegation in the FIR at issue, when raid was conducted at the pan shop owned by the petitioner, certain materials were recovered which indicates that the accused have been indulging in committing offence under the Assam Game and Betting Act. 3. It has been pleaded in the petition that co-accused has already been released on bail by the Lower Court, after their arrest. It has been pleaded that the petitioner is a married person living with his family and has no criminal antecedents. 4. Considering the nature of allegations and the fact that petitioner was not apprehended at the spot, I deem it just and proper to grant interim anticipatory interim bail to the petitioner. 5. Consequently, it is directed that in case of arrest of the petitioner, he be released on bail on his furnishing two sureties in the sum of Rs.10,000/- each to the satisfaction of the arresting/investigating officer. 6. It is directed that the petitioner shall neither influence nor intimidate any witness. 7. List on 27th January, 2020.
