JUDGMENT 1. The instant writ petition, in the nature of Public Interest Litigation, is filed by the petitioners seeking undermentioned reliefs: (i) It may kindly be directed that no person, in any manner, shall pollute water of the Guruo Ka Talab situated in the city of Jodhpur. (ii) It may kindly be directed that any act of causing pollution to the Pond Guruo Ka Talab shall be treated as a "Public Nuisance" defined under Section 268 of the Indian Penal Code and shall also be treated as an offence of "fouling water of public pond" described under Section 277 of the Indian Penal Code in addition to the offence provided under relevant environmental laws. (iii) It may kindly be directed the act of polluting ponds shall also include immersion of idols, glitters, clothes, coconut shells, bamboos and all articles made by plastic or the material akin to that and plaster of paris or the material akin to that; (iv) It may kindly be directed there shall be complete prohibition for bathing in the pond aforesaid by using soap and washing clothes at the pond abovementioned (note this direction shall not restrict bathing without use of soap, if not otherwise prohibited)." 2. Essentially, the concern of the petitioners is that immersion of idols in water body namely Guruo Ka Talab, Jodhpur is polluting its water and further adversely affecting water irrigation system. After issuance of notice, Mr. R.S. Saluja has put in appearance on behalf of the Municipal Corporation, Jodhpur and the State has also filed reply to the writ petition. On behalf of the Municipal Corporation, Jodhpur, in order to address afflictions of the petitioners, compliance affidavit along with requisite annexures is submitted through its Health Officer, Municipal Corporation, Jodhpur. 3. As per the compliance affidavit, Municipal Corporation, Jodhpur has undertaken requisite measures for cleaning Guruo Ka Talab and further taken other stringent measures to prevent immersion of idols in the water bodies including Guruo Ka Talab. 4. Upon perusal of the requisite documents annexed with the compliance affidavit, we are convinced that adequate steps have been taken by the Municipal Corporation, Jodhpur to prevent the menace of immersion of idols in the water bodies. It is also borne out from the compliance affidavit that the Municipal Corporation, Jodhpur shall take utmost care in future also not to permit immersion of idols in Guruo Ka Talab, Jodhpur. 5.

In view of the compliance affidavit, we are of the view that no further directions are required. The Public Interest Litigation is, therefore, disposed of.
