JUDGMENT : ANIRUDDHA BOSE, J. 1. The writ petition of the appellant seeking appointment on compassionate ground was dismissed primarily on the reasoning that there was no specific scheme for giving compassionate appointment to a person who was dependent at the time of death of the deceased employee. 2. The father of the appellant died on 7th February, 1980. At that point of time, the appellant was one year eight months of age. Relying on the judgment of Hon’ble Supreme Court in the case of National Institute of Technology and Others Versus Niraj Kumar Singh reported in (2007) 2 SCC 481 , the learned First Court dismissed the writ petition. 3. We do not find any error in the reasoning of the learned First Court in dismissing the writ petition. 4. The writ petition was instituted in the year 2009 seeking compassionate appointment on the ground of the applicant’s father having died in harness on 7th February, 1980. One of the basic objects of giving appointment on compassionate ground is to assist the family of the deceased tide over the immediate crisis caused by death of an earning member of the family. So far as this proceeding is concerned, nearly 40 years have lapsed since death of the concerned employee. The appeal is accordingly dismissed.
