JUDGMENT Sanjay Kumar Dwivedi, J. - Heard Mr. Mrinal Kanti Roy, learned counsel for the petitioner and Mr. Amitabh Prasad, learned counsel for the respondents. 2. The petitioner has preferred this writ petition for quashing the order 22.01.2008 whereby the departmental proceeding against the petitioner has been initiated. 3. Mr. Roy, learned counsel for the petitioner submits that the departmental proceeding was initiated against the petitioner and thereafter he is not able to contact the petitioner. He further submits that the petitioner has not come forward with any instruction as to what happens in the departmental proceeding. 4. This Court finds that there is no reason to keep this writ petition pending wherein the challenge is only to the effect to stay the initiation of departmental proceeding. By that some positive order would have been passed and accordingly, the writ petition stands dismissed. 5. The liberty is reserved with the petitioner to avail further remedy if the cause of action still survive pursuant to that initiation of departmental proceeding. 6. Accordingly, the writ petition stands dismissed.
