JUDGMENT : 1. This writ petition is under Article 226 of the Constitution of India, whereby and whereunder direction has been sought for upon the respondents for repairing, proper maintenance as also for doing white-washing over the Bar Building of Rajmahal Bar Association, since after its construction completed sometime in the year 2008, due to lack of maintenance, the condition of the building has deteriorated, causing difficulties to the members of the Bar in discharging their day to day function. 2. Counter affidavit has been filed by the Respondent-State of Jharkhand in pursuance to the order passed on 26.06.2019, wherein a communication dated 06.08.2019, made in the name of the Accountant General, Jharkhand, issued under the signature of the Secretary, Building Construction Department, Government of Jharkhand, whereby and whereunder the administrative approval as also the sanction for the required amount, which will incur in the construction of the Bar Building in question, has been granted. In pursuance thereto, the short notice inviting tender has also been issued. 3. Mr. Prashant Kumar Singh, learned G.P. II appearing for the Respondent-State of Jharkhand has submitted on instructions that since the Tender has been issued, as would be evident from Annexure-B to the counter affidavit and as such, the construction of repair work thereof, shall be completed within the period of four months. In view thereof, he has fairly submitted that the writ petition may be disposed of. 4. This Court after taking into consideration the aforesaid aspect of the matter and looking to the administrative approval of the amount to be incurred in the repair work or the construction of the Bar Building of the Rajmahal Bar Association as also the fact that the Short Notice Inviting Tender has been issued, therefore, the Respondent-Secretary of the Building Construction Department (Respondent No. 3) is directed to ensure compliance of the time schedule mentioned in the Short Notice Inviting Tender, so that the work in question be completed under the said time schedule. 5. Accordingly, the writ petition stands disposed of.
