body2019
JUDGMENT Manoj Kumar Garg, J. - The present misc. petition under Section 482 Cr.P.C., 1973 has been filed by the petitioner for recalling the order dated 15.04.2019 passed by this Court. 2. Counsel for the petitioner submits that the learned trial Court issued arrest warrant against the petitioners, and now the petitioners are ready to appear before the trial Court. Therefore, in these circumstances, the arrest warrant so issued against the petitioners may be converted into bailable warrant and they will appear before the trial court and will raise all objections at the time of framing of charges. 3. Learned Public Prosecutor opposed the petition. 4. Heard the learned counsel for the parties. 5. I have considered the arguments advanced before me. It is also came on record that main accused Chaju Ram has already been acquitted by the trial Court, so in these circumstances, the arrest warrant issued by the trial court is hereby converted into bailable warrant of Rs. 30,000/-. The petitioners are directed to appear before the trial court within a period of one month from today. 6. However, looking to the peculiar facts and circumstances of the case, liberty is granted to the petitioners to raise all the objections before the trial court at the time of framing of charges. The misc. petition is disposed of accordingly.
