ORDER 1. This Special Leave Petition is against the order of the Division Bench, the operative portion whereof is set out herein below: "In these circumstances, it is hereby directed that the appellant society is at liberty and is free to continue with the tender process as it exists, subject to the condition that award of tender and contract would be subject to the final outcome of the proceedings and the successful tenderer, if any, would be intimated about the pendency of the litigation." 2. The petitioner is fully protected. The respondent society has only been given the liberty to continue with the tender process and to award tender which would be subject to the final outcome of the proceedings and the successful tenderer, if any, would have to be intimated about the pendency of the litigation. Since the petitioner is protected by the interim order of the Division Bench we find no ground to interfere. It is expected that the writ petition shall be disposed of as expeditiously as possible considering the urgency. 3. Needless to mention that the writ petition is to be decided by the High Court on its own merits independent of any observations that may have been made in the appeal. 4. The Special Leave Petition stands disposed of. Pending application(s), if any, stands disposed of accordingly.
