ORDER 1. Leave granted. 2. The appellant is asserting that the road has not been removed whereas the stand of the State and other respondents is that the road has been removed. 3. It would be appropriate to direct the Executing Court to appoint a Court Commissioner so as to find out whether the road in question has been removed or not and act accordingly. 4. The order(s) passed by the High Court as well as by the Executing Court are modified to the aforesaid extent. 5. In view of the above, the appeal is disposed of. Pending interlocutory application(s), if any, is/are disposed of.
