ORDER 1. The National Consumer Disputes Redressal Commission ("NCDRC") forfeited the right of the appellant to file its written statemen t for default in complying with the time schedule prescribed in law. 2. On the previous occasion, we had granted an adjournment to the learned counsel on behalf of the respondent, Tamil Nadu Agricultural University to seek instructions on whether the University would be willing to accept an order of costs subject to which the written statement may be taken on record. 3. After taking instructions, learned counsel appearing on behalf of the respondent fairly states that there is no objection to this course of action being taken. 4. We accordingly, direct that the written statement of the appellant shall be taken on record by the NCDRC subject to the payment of costs quantified at Rs. 2,00,000/- (Rupees Two Lakhs Only) to the respondent which shall be a condition precedent. 5. Conditional on the payment of costs within a period of two weeks, the written statement can be filed within a period of three weeks from today. 6. The NCDRC is requested to expedite the disposal of the consumer complaint. 7. The civil appeal is, accordingly, disposed of. No costs. Pending application(s), if any, shall also stand disposed of.
