JUDGMENT : ARUN BHANSALI, J. 1. This writ petition has been filed by the petitioners seeking directions to the respondents to provide adequate relaxation to the petitioners in minimum qualifying marks of REET 2017 in TSP female category, consider the candidature of the petitioners pursuant to the advertisement dated 12.4.2018 for the post of Teacher Gr. III (Level-I) in TSP Female category and to provide appointment to the petitioners on the post of Teacher Gr. III (Level-I) in TSP female category. 2. The petitioners, who belong to general/OBC category and are residents of TSP area, appeared in REET 2017 and obtained 56% marks, 56% marks and 58% marks respectively and were declared not eligible by the Board. 3. An advertisement dated 12.4.2018 (Annex.6) for the post of Teacher Gr. III (Level-I) was issued by the respondents, wherein, the requirement indicated was minimum 60% marks in REET 2017 and for candidates of Scheduled Tribes of TSP area, the same was indicated at 36% marks. 4. Admittedly, the petitioners do not belong to ST (TSP) and as they have obtained less than 60% marks in REET 2017, they are ineligible for appointment pursuant to the advertisement dated 12.4.2018. 5. Various submissions which have been made in the writ petition and the relief claimed is based on ignorance of the fact that the requirement of 60% marks in REET 2017, is based on Rule 266 of the Rajasthan Panchayati Raj Rules, 1996 (the Rules of 1996) and the relaxation has been granted to ST candidates of TSP area based on the notification dated 29.8.2012 issued by the State Government, which is not applicable to the candidates like petitioners. 6. Without questioning the validity of the provision/notification issued by the respondents, the challenge laid by the petitioners and the relief claimed is absolutely baseless. 7. In view of the above discussion, there is no substance in the writ petition. The same is, therefore, dismissed.
