JUDGMENT Ajay Mohan Goel, J. (Oral) - By way of this petition filed under Section 439 of the Code of Criminal Procedure Code (hereinafter referred to Cr.P.C. for short), petitioner has prayed for grant of regular bail in FIR No. 110 of 2018, dated 28.10.2018, registered at Police Station Bharari, District Bilaspur, under Sections 307, 341, 323 read with Section 34 of Indian Penal Code (hereinafter referred to IPC for short). 2. Learned Additional Advocate General has filed the status report which is perused and taken on record. 3. Mr. Neel Kamal Sharma, learned Counsel for the petitioner submits that in a similar petition filed by another accused, who in fact is the main accused, this Court has already released the said accused namely Jagvir Singh on regular bail on 08.01.2019 in Cr.M.P(M) No. 1823 of 2018, titled as Jagvir Singh vs. State of Himachal Pradesh . This fact is not disputed by the respondent-State. Accordingly, this application is allowed and the petitioner is ordered to be released on bail on the following terms and conditions:- i) That he shall furnish personal bond in the sum of 2,00,000/- with two sureties in the like amount, to the satisfaction of the learned JMIC, Ghumarwin. ii) That he shall join the investigation, as and when required by the Investigating Agency. iii) That he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to the Police. iv) That she shall not leave India without the prior permission of the Court. v) That he shall deposit his passport, if any, with the Police Station, concerned. vi) That in case of violation of any of the conditions, the bail granted to the petitioner shall be forfeited and he shall be liable to be taken into custody. 4. It is clarified that findings which have been returned by this Court while deciding this petition are only for the purpose of adjudication of the present bail application and learned trial Court shall not be influenced by any of the findings so returned by this Court in the adjudication of this petition during the trial of the case. The petition stands disposed of in the above terms. Copy dasti.
