JUDGMENT : 1. The instant writ petition has been filed by the petitioner challenging the order dt. 6th September, 2016, whereby the Disciplinary Authority has imposed penalty of dismissal from service after holding the regular Departmental enquiry under Rule 16 of CCA Rules, 1958. 2. Learned counsel for the petitioner while making submissions, submitted that petitioner has approached the Appellate Authority by filing appeal in the month of October, 2018 and the said appeal has not been decided so far by the Principle Secretary, Medical and Health Department, Government of Rajasthan, Jaipur. 3. Counsel submitted that the petitioner may be given liberty to approach the Appellate Authority and he should be directed to decide the appeal in expeditious manner. 4. This Court finds that the petitioner has already filed appeal before the Appellate Authority in the month of October, 2018 and the appeal is required to be decided in expeditious manner. 5. Accordingly, the present writ petition stands disposed of, with a direction to the Appellate Authority to decide the Departmental Appeal of the petitioner in expeditious manner, but in no case later than eight weeks from the date of receipt of copy of this order. 6. Counsel for the petitioner has sought liberty to assail the order of the Appellate Authority, in case, it is decided against the petitioner. 7. This Court finds that the petitioner is always at liberty to avail the appropriate remedy under the law, in case, the appeal is decided against him.
