JUDGMENT : Shekher Dhawan, J. 1. Present petition under Section 482 of the Code of Criminal Procedure is for quashing of FIR No. 457 dated 1.12.2016 under Section 509 IPC registered at Police Station Murthal, District Sonepat (Annexure P/7) and all subsequent proceedings arising therefrom. 2. At the commencement of hearing, learned State counsel opposed the present petition for quashing of above mentioned FIR on the ground that the present petition is not maintainable because on the basis of statement of the complainant recorded under Section 164 Cr.P.C. Sections 354-C and 354-D IPC have also been added in the instant case and the petitioner has not challenged the same. As such, the present petition is not maintainable and deserves to be dismissed. 3. Having considered the submissions made by learned counsel for the parties and the fact that the present petition has been filed for quashing of aforesaid FIR registered under Section 509 IPC only whereas Sections 354-C and 354-D IPC have also been added, this Court is of the considered view that the present petition is not maintainable and the same stands dismissed with liberty to the petitioner to file fresh petition on amended facts, if so required.
