JUDGMENT Anubha Rawat Choudhary, J. - Heard Mr. Rajendra Kumar Sinha, counsel appearing on behalf of the petitioner along with MR. Amit Sinha, Advocate. 2. Counsel for the State is present. 3. This petition has been filed for the following relief: - for quashing the entire criminal proceeding in connection with R.C. Case No. 09(S) of 2013-R registered for committing an offence punishable under Sections 120B,406,420,467,468,471,506 and 34 of the Indian Penal Code, including the order dated 20.08.2014 whereby and whereunder, learned Additional Judicial CommissionerXVI-cum-Special Judge (In-charge), C.B.I., Ranchi has been pleased to find prima facie case made out against the petitioner and take cognizance for the offence punishable under Section 120B read with Sections 406 and 420 of the Indian Penal Code and Section 13(2) read with Section 13 (1) (d) of the Prevention of Corruption Act,1988, now the case is pending in the court of Sri R. K. Choudhary, learned Additional Judicial Commissioner-XVI-cumSpecial Judge (In-charge), C.B.I., Ranchi. 4. Counsel for the petitioner seeks permission to withdraw this petition. 5. Counsel for the State has no objection to the prayer for withdrawal. 6. Permission for withdrawal is accorded. 7. Accordingly, this Cr. M.P. No. 2185 of 2014 is dismissed as withdrawn. 8. Interim order, if any, stands vacated. 9. Pending interlocutory application, if any, are also dismissed as not pressed. 10. It is made clear that dismissal of this petition will not prejudice the case of either parties in any manner whatsoever. 11. Let this order be communicated to the concerned court through FAX.
