DINESH MEHTA, S.RAVINDRA BHAT

body2019
JUDGMENT : Civil Misc. Application No. 1/2019: 1. For the reasons stated in the application, delay in filing the appeal is condoned. 2. The application is allowed. Special Appeal (Writ) No. 340/2019: 3. The appellant is aggrieved by an order of the learned Single Judge rejecting his writ petition. The learned Single Judge was of the opinion that since the admission to B.Ed. was obtained after 31.08.2009, which meant, in turn, that the candidate had to possess 50% marks in graduation (for the purposes of the subject selection in recruitment), the direction sought could not be granted. 4. This Court is of the opinion that the impugned order is not erroneous and is in conformity with the Division Bench judgment in Sushil Sompura & Ors. v. State of Rajasthan & Ors. [D.B. Civil Writ Petition No. 3964/2011, decided on 20.05.2011] and recent Division Bench ruling in Anil Kumar Trivedi v. State of Rajasthan & Ors. [D.B. Special Appeal (Writ) No. 514/2019, decided on 06.05.2019]. 5. The appeal is, accordingly, dismissed.
