ORDER 1. Heard learned counsel for the appellants as well as learned counsel appearing on behalf of the respondents. 2. Delay in filing the application for bringing on record the legal representatives of deceased respondent No.3 is condoned. Abatement, if any, is set aside and the application for bringing on record the legal representatives of deceased respondent No.3 is allowed in terms of the prayer made. 3. Leave granted. 4. Learned counsel appearing on behalf of the appellants has made a suggestion before this Court that the appellants will give to the respondents equal value of land in the same village and handover the same within a period of one month from today. Learned counsel for the respondents agrees with the suggestion made by the learned counsel for the appellants 5. In view of the agreed compromise between the parties and without expressing any opinion on the merits of the dispute, we set aside the impugned order passed by the High Court and restore the order passed by the first Appellate Court. 6. As per the compromise, mentioned supra, arrived at between the parties before this Court, the appellants will register and handover to the respondents a piece of land having equal value of the disputed property situated in the same village and handover possession of the same within one month from this date. 7. The appeal is, accordingly, disposed of.
