body2019
JUDGMENT : 1. By way of this writ petition, the petitioners have questioned the vires of Rule 14 of the Rajasthan Civil Services (Revised Pay Scale) Rules, 2008 (for short, hereinafter referred to as Rules of 2008). 2. Learned counsel appearing for the petitioners submits that in the writ petition involving identical question being DBCWP No. 4253/2019 (Ramesh Chand Saini & Ors. v. State of Rajasthan & Ors.), on the petitioners therein not pressing the challenge to vires of Rule 14 of the Rules of 2008, this Court has issued direction to the respondents to decide the representation/s to be made by the petitioners within a stipulated time. Learned counsel for the petitioners also does not want to press the challenge to vires of Rule 14 of Rules of 2008 and the petition preferred by them may also be disposed of in the light of order dated 12.03.2019 passed by this Court at Jaipur Bench in DBCWP No. 4253/2019 (supra). 3. The operative portion of the order dated 12.03.2019 passed in Ramesh Chand Saini (supra) reads thus: "We, therefore, direct the State Government to undertake necessary exercise and pass appropriate order with regard thereto within a period of four months from the date of production of copy of this order. It goes without saying that in case grievances of the petitioners are not remedied, the petitioners would be at liberty to file fresh writ petition with the same prayer as made in the present writ petition and also incorporating challenge to the order that may be passed by the State Government. With the aforesaid direction, writ petition stands disposed of." 4. The prayer of petitioners is not opposed by the learned counsel appearing for the respondents. 5. Accordingly, this writ petition is also disposed of in the light of directions issued by this Court at Jaipur Bench in the case of Ramesh Chand Saini (supra).
