JUDGMENT Sujit Narayan Prasad, J. - This writ petition is against the order dated 18.02.2016 passed by the appellate authority under Section 45-AA as also order passed under Section 45-A dated 27.03.2015 under the Employees State Insurance Act,1948 (in short ''Act,1948''), have been assailed. 2. At the outset, Mr. Ashutosh Anand, learned counsel for the respondents-ESIC raised the preliminary objection with regard to availability of alternative remedy provided under Section 75 of the Act,1948. 3. Upon which, learned counsel for the petitioner has sought for permission to withdraw the writ petition with liberty to avail the alternative remedy, as provided under Section 75 of the Act,1948, which has not been objected by the counsel for the respondents-ESIC. 4. In view thereof, this Court, without entering into the merit of the claim of the petitioner, dispose of the writ petition, by granting liberty to the petitioner to approach before the appropriate forum under the Act,1948. 5. Learned counsel for the petitioner has submitted that before the forum, the question of limitation would be a issue. 6. This Court is of the view that if that would be so, the forum shall pass appropriate order in accordance with law. 7. Accordingly, the writ petition stands disposed of.
