JUDGMENT Anubha Rawat Choudhary, J. - Nobody appears on behalf of the petitioner. 2. Heard Mr. T. N. Verma, counsel appearing on behalf of the opposite party. 3. This petition has been filed for the following reliefs: - "for issuance of appropriate order/orders, direction/directions For quashing of entire criminal proceeding including FIR in connection with Vigilance P.S. Case No. 09/2017 corresponding to Vigilance Case No. 10/2017 registered u/s 13(2) r/w 13(1)(c) of P.C. Act, now pending in the court of Sri Santosh Kumar-II, Special Judge, Vigilance, Ranchi." 4. Mr. Rameshwar Oraon, Deputy Superintendent of Police, Anti-Corruption Bureau, Ranchi, who is the Investigation Officer of the case, is present in the court along with the casediary and has filed a supplementary counter affidavit in compliance of the order dated 06.08.2019 passed by a Coordinate Bench of this Court. 5. Counsel for the opposite party submits that the investigation is still going on and during investigation sufficient material has been collected against the petitioner. He submits , by referring to the case diary , that a notice has been issued to the petitioner through the Executive Engineer, NREP-1, Ranchi asking him to appear vide Letter No. 13112 dated 28.12.2018, but he has not yet appeared for recording of his statement before the I.O. 6. Since nobody is appearing on behalf of the petitioner in spite of repeated calls, the present Cr. M. P. No. 2388 of 2017 is dismissed for non-prosecution. 7. Interim order, if any, stands vacated. 8. Pending interlocutory applications, if any, are also dismissed. 9. It is further observed that dismissal of this petition will not prejudice the case of either parties before the learned court below in any manner whatsoever. 10. Let a copy of this order be communicated to the concerned court through FAX.
