JUDGMENT Anubha Rawat Choudhary, J. - Heard Chandra Shekhar Pandey, counsel appearing on behalf of the appellant. 2. Counsel for the State is present. 3. This petition has been filed for the following relief: - "That instant appeal arises against the judgment dated 06.10.2018 and sentence dated 06.10.2018, passed by Sri Subhash, Additional Sessions Judge-V cum Special Judge (POCSO), East Singhbhum, Jamshedpur in Session Trial No. 280/2015, whereby and where under the appellant has been found guilty for the offence under section 376/511 of IPC and 4/8 of POCSO Act and thereafter appellant has been convicted U/s 8 of the POCSO Act and sentenced to undergo rigorous imprisonment for three years and fine of Rs. 2,000/- for offence U/s 8 of POCSO Act. In default of fine, the convict will undergo further imprisonment of one month." 4. Pursuant to order dated 26.08.2019, a report has been received from the Office of District & Additional Session JudgeV, East Singhbhum, Jamshedpur indicating that the appellant has already served the sentence. 5. Counsel for the appellant submits that in such circumstances, the present appeal has become infructuous and he does not want to press it. 6. Counsel appearing on behalf of the State does not dispute the submissions made on behalf of the appellant. 7. Considering the facts and circumstances of this case the present Cr. Appeal (SJ) No. 282 of 2019, is hereby dismissed as not pressed.
