JUDGMENT : Ajay Mohan Goel, J. By way of the present Contempt Petition, petitioner alleges willful disobedience of the judgment passed by this Court in CWP No.2435 of 2017, titled as Ram Chand Versus State of Himachal Pradesh and others, decided on 06.12.2018, which stood allowed in the following terms:- "The writ petition is thus allowed with a direction to the official respondents to arrange the necessary funds and complete the construction of road upto village Harijan Basti Mathakali with a period six months, subject to the availability of the land as may have been provided by the residents of the area. The left out stretch of the road shall be constructed by the Himachal Pradesh Public works Department". 2. Executive Engineer, Rampur Division, Shimla, H.P., who is present in the Court, submits that the road in issue could not be constructed primarily for the reason that the residents of the area, who own part of the land, are not willing to part with the same and formally hand over ownership of the same to the government. 3. Learned Additional Advocate General has also drawn the attention of this Court towards para 5 of the judgment passed by this Court, contempt of which is alleged and by referring to the same he has submitted that the Court was alive to the said situation even at the time when the order was passed on 06.12.2018 as there is a specific reference in the judgment passed by this Court viz-a-viz construction of the road i.e. that the same shall be subject to the availability of the land as may be provided by the residents of the area. 4. At this stage, Execution Engineer submits that in order to ensure connectivity, the department has explored the possibility of an alternative road also, length of which is about 1 kilometer, but as the same involves felling of about 25 Devdar trees and further as the same involves forest land, the department cannot act further till necessary clearance is granted to the State under the provisions of the Forest Conservation Act, 1980. 5.

Alongwith the reply, which has been filed to the Contempt Petition and which stands handed over in the Court today itself, there is an Annexure appended i.e. Annexure R-2, dated 16.07.2019, perusal of which demonstrates that Superintending Engineer, 11th Circle, HPPWD, Rampur Bushar, District Shimla, H.P. has taken up the matter with the Director Social Justice and Empowerment Department of Himachal Pradesh, seeking Administrative approval and Expenditure sanction for the purpose of construction of the road in issue. 6. In view of what has been stated hereinabove, in my considered view, this is not a case wherein it can be said that there is a willful disobedience of the Court order. However, this Court can also not loose sight of the fact that the villagers are entitled for the road for which trouble has been taken by the petitioner herein by first approaching this Court by way of writ petition and thereafter, by way of present Contempt Petition. 7. Accordingly, the Contempt Proceedings are closed by taking on the record assurance of learned Additional Advocate General that endeavour shall be made to provide connectivity in terms of the judgment passed by this Court as early as possible, however, subject to receipt of the necessary Administrative approval and Expenditure sanction as also approval as envisaged under the Forest Conservation Act, 1980. 8. This Court hopes and expects that the authorities which are to grant such approvals and sanctions, shall do so as expeditiously as possible. Petitioner shall be at liberty to peruse the matter with the authorities concerned. Petition is disposed of. Notice stands discharged. Pending miscellaneous applications, if any, also stand disposed of. Interim order, if any, stands vacated.
