JUDGMENT Mr. Mahabir Singh Sindhu, J. (Oral):- Present petition has been filed under Section 439 Cr.P.C. seeking bail pending trial in FIR No. 53 dated 05.05.2018, under sections 399, 402, 411 & 201 of the Indian Penal Code, registered at Police Station Lambra, District Jalandhar. 2. Learned counsel for the petitioner submits that the petitioner is in custody since 05.05.2018 and after investigation in the matter report under Section 173 Cr.P.C. was presented way back on 03.07.2018, but till date charges have not been framed. 3. The above factual position is duly acknowledged by learned State counsel on instructions from ASI Kewal Singh, but opposed the bail on the premise that petitioner is facing one more criminal case. 4. Heard learned counsel for the parties and perused the paper book. 5. Undisputedly, the petitioner is in custody since 05.05.2018 and the report under Section 173 Cr.P.C. was presented on 03.07.2018, but till date charges have not been framed, thus the trial is likely to take a long time to be concluded. Although petitioner is facing another case under NDPS Act in which contraband was allegedly recovered of small quantity and he is stated to be on bail. Thus, no useful purpose would be served by keeping the petitioner behind the bars any more. 6. In view of the abovesaid circumstances, without expressing any opinion on the merits of the case, this petition is accepted. Petitioner-Jaspreet Singh @ Veeru be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate concerned. 7. However, it is made clear that above observations may not be construed as an expression of opinion on the merit of the case pending before learned trial Court.
