JUDGMENT Sujit Narayan Prasad, J. - The writ petition is for issuance upon restraining the respondents from interfering with the Title, Ownership and peaceful possession of the petitioner over ponds, First Bara Saira Talab spread over Khata No.46, Plot No.965 & 966 and Chhotki Saira Talab spread over Khata No.46, Plot No.806 & 807. 2. The petitioner has claimed his right over the said land and in support thereof, he has filed Rent Receipt. 3. Counter-Affidavit has been filed by the respondents wherein specific stand has been taken by referring to the judgment/decree passed in Title Suit No.117/90 which was dismissed on 28.02.2007 and affirmed in appeal being Title Appeal No.45/07. 4. It has further been stated that in the judgment dated 28.02.2007 the land which has been shown to be recorded in the State of Bihar as Anabad State of Bihar therefore, the petitioner has got no title over the said land. 5. At this juncture, learned counsel for the petitioner seeks permission for withdrawal of this writ petition with a liberty to approach before the competent forum for redressal of his grievance. 6. Accordingly, the writ petition is dismissed as withdrawn with aforesaid liberty.
