JUDGMENT Mr. Ajay Tewari, J. (Oral):- This petition has been filed under Section 439 Cr.P.C for grant of regular bail to the petitioner in case FIR No.131 dated 29.9.2018 registered under Sections 458/307/324/148 and 149 IPC, 1860 and Section 326 IPC was added later on at police station City Rampura, District Bhatinda. 2. Learned Counsel for the petitioner has argued that invocation of Section 307 IPC is debatable since all the injuries are on arm and leg. 3. Learned DAG on instruction from SI Kewal Singh states that injuries were on the arm because the injured was trying to stave off the blow hit which was aimed at his head. Further, four more cases are also pending against the petitioner. 4. Custody certificate dated 23.5.2019 by way of affidavit of Manjit Singh, PPS, Deputy Superintendent, Central Jail, Bhatinda has been filed on behalf of the respondent-State, the same is taken on record. Copy has been supplied to the opposite counsel. The custody certificate also certifies the fact that the petitioner has been in custody for 5 months and 8 days. 5. Without commenting on the merits of the case, keeping in view the above facts and the period of incarceration already suffered by the petitioner, I deem it appropriate to grant regular bail to the petitioner. Ordered accordingly, Bail to the satisfaction of the concerned Trial Court/Duty Magistrate. It is however clarified in case the petitioner does not submit bail bonds, he would not be able to count this period as custody period in this FIR after today. 6. Petition stands allowed. 7. Since the main case has been decided, the pending criminal miscellaneous application, if any, also stands disposed of.
