JUDGMENT : 1. This application for bail has been filed by the petitioner under Section 439 of the Cr.P.C. in connection with FIR/CR No. 59/2019, Police Station Napasar (Bikaner), for the offences under Sections 307, 458, 427 & 147 IPC and the offence under Section 27 of the Arms Act. 2. Heard learned counsel for the petitioner, learned Public Prosecutor and the learned counsel for the complainant. Perused the material available on record. 3. Mr. J.S. Choudhary, learned Senior Counsel submits that the allegation levelled against the petitioner in the FIR is that the petitioner along with Ramniwas and Gopalram were having pistols in their hands and Gopalram and Ramniwas had opened fire from such pistols. He further points that even the empty magazine has been recovered from Ramniwas and there is no allegation against petitioner. 4. Learned Public Prosecutor and the learned counsel for the complainant vehemently opposed this bail application and submitted that the petitioner along with other accused persons had come on the place of incident with a premeditated mind. If the bail is granted to him that would lead to social disorder. 5. Having regard to the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted. 6. Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Ram Chandra S/o Surja Ram, arrested in connection with FIR/CR No. 59/2019, Police Station Napasar (Bikaner) shall be released on bail; provided he executes a personal bond in the sum of Rs. 50,000/- and two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
