JUDGMENT : 1. These applications for grant of bail have been filed by the petitioners under Section 439 of the Cr.P.C. in connection with FIR No. 36/2019, Police Station Sandwa, District Churu for the offences under Sections 395, 365, & 323 IPC readwith Section 3/25 of Arms Act. 2. Heard learned counsel for the petitioners and learned Public Prosecutor and also perused the material available on record. 3. Mr. Bijarnia, learned counsel for the petitioners submits that out of the six accused persons, four have already been enlarged on bail by separate orders passed by this Court in Criminal Misc. Bail Applications No. 5619/2019, No. 5242/2019 & No. 5617/2019. 4. Learned counsel submits that petitioners case is not different than the other co-accused, who have been enlarged on bail. 5. Learned Public Prosecutor is not in a position to point out any factual difference as far as petitioners involvement is concerned. Having regard to the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the bail applications filed by the petitioners deserves to be accepted. 6. Consequently, the bail applications filed under Section 439 Cr.P.C. are allowed. It is ordered that petitioners (1) Sahdev S/o Kunjbihari and (2) Bhimdan S/o Mohan Dan arrested in FIR No. 36/2019 Police Station Sandwa, District Churu shall be released on bail; provided they execute personal bond in the sum of Rs. 50,000/- and two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
