ORDER We are not satisfied with the affidavits filed on behalf of the State of Jharkhand as well as the State of Bihar as they are passing on their responsibility upon the Principals of the Colleges and the University. In the circumstances, we direct the State Governments to make further inquiry into it at their own level and not to rely upon the Principals of the Colleges and the University. The State Governments to submit the report in this Court on the various aspects as enumerated in the order dated 11.07.2019. 2. We also requisition the record of Justice S.C. Agrawal Commission and Justice S.B. Sinha Commission to ascertain what is stand taken by the incumbents and in the various representations which have been filed time to time and in the writ petition filed in the High Court as well as in application filed in this Court. Let the material be placed before us by the concerned State Governments as well as by the incumbents who are the beneficiaries of the order passed by Justice S.B. Sinha Commission. 3. It was pointed out that after absorption certain incumbents are rendering their services and they are not being paid their current salary. In case, any incumbent is rendering his services after absorption obviously he has to be paid his current salary without prejudice to rights of State and in case declaration is found to be incorrect we will pass appropriate orders. 4. There are 40 colleges in both the States. We feel independent inquiry is necessary to find out the actual position as reflected in order dated 11.07.2019 passed by this Court. Let two Forensic Auditors be nominated one each by the Enforcement Directorate and Central Bureau of Investigation. The State Governments/University/Colleges shall furnish the material to conduct the inquiry including accounts etc. as may be required by the Auditors. Let the Registry inform the Central Bureau of Investigation and Enforcement Directorate immediately to do the needful. 5. Two months' time is granted as prayed for to conduct the deep probe into the matter and to place the inquiry report in this Court along with the relevant material. 6. List only Contempt Petition(c) No. 1188/2018 in C.A. No. 2703/2017 on 03.09.2019 for further hearing as prayed for. 7. List other matters on 16.10.2019.
