JUDGMENT 1. The petitioner seeks quashing of the entire criminal proceeding arising out of Dhurwa (Tupudana) P.S. Case No.196 of 2015 corresponding to G.R. No.4511 of 2015 which has been registered for the offence under section 406/420 IPC. 2. Stand taken by the petitioner is that on an allegation of breach of an agreement, a criminal proceeding for offence under section 406/420 IPC cannot continue. 3. It is stated that now the case is posted for hearing. 4. Evidently, at this stage when materials have appeared against the petitioner, the criminal proceeding arising out of Dhurwa (Tupudana) P.S. Case No.196 of 2015 cannot be quashed. 5. In the result, Cr. M.P. No.123 of 2016 is dismissed.
