JUDGMENT : 1. The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No. 63/2019, Police Station Mathania, District Jodhpur City East, for the offences under Section 377 of IPC and Section 3/4 of Protection of Children from Sexual Offence Act, 2012. 2. Learned counsel for the petitioner submits that the FIR has been lodged about 20 days after the date of the incident. It is stated that the petitioner was minor at the time of the incident and the complainant is said to be a consenting party. The petitioner has been falsely implicated in this case. 3. Learned Public Prosecutor has opposed the bail application but admitted that the applicant was about 18 years of age at the time of offence as the date of birth of the accused petitioner is 06.04.2001. 4. Heard and considered the arguments advanced by the learned counsel for the petitioner and learned Public Prosecutor. 5. Having regard to the facts and circumstances of the case and more particularly taking into account the fact that the FIR has been lodged after 20 days of the alleged incident and the exact date of the incident has not been mentioned in the FIR. The petitioner was said to be minor at the time of the incident. 6. Without expressing any opinion on the merits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted. 7. Consequently, the bail application is allowed. It is ordered that the accused-petitioner- Bharat Rao S/o Ramu Ram arrested in connection with F.I.R. No. 63/2019 shall be released on bail; provided he furnishes a personal bond of Rs. 50,000/- and two surety bonds of Rs. 25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
