JUDGMENT : 1. This order shall dispose of WP(C) No. 175 of 2019 and WP(C) No. 177 of 2019 as learned counsel for the parties have agreed that the issues involved are identical. However, facts have been taken from WP(C) No. 175 of 2019. 2. The challenge in these Writ Petitions (Civil) filed under Article 226 of the Constitution of India is to letter dated 13.05.2019 issued by the Under Secretary to the Govt. of Meghalaya, Food Civil Supplies and Consumer Affairs Department, Govt. of Meghalaya, Shillong whereby, the respondents have denied approval of the petitioners for an appointment as Government Nominee/Agent/Whole Seller for the year 2019 for Umroi Centre, Ri-Bhoi District, Nongpoh, Meghalaya even though the petitioners possessed adequate experience in Public Distribution System and preferential rights under the Meghalaya Food Grains (Public Distribution System) Control Order 2004. 2.1 Learned State counsel on the last date of hearing i.e., 31.05.2019 submitted that the work order has been issued on 28.05.2019 and had sought time to produce the record as well as the order dated 28.05.2019 today. Copy of the same has been produced and photo copies have been given to the learned counsel for the petitioners. 3. Learned counsel for the petitioners submitted that since during the pendency of the writ petitions, the work order dated 28.05.2019 has been issued, he may be allowed to withdraw the writ petitions with liberty to the writ petitioners to assail the same and also letter dated 13.05.2019 which is the subject matter under challenge in these writ petitions. 4. In view of the above, both the petitions are dismissed as withdrawn. However, liberty is granted to the petitioners to take recourse to available remedies to challenge the work order dated 28.05.2019 issued by the respondents and also the letter dated 13.05.2019 in accordance with law. 5. The original order has been returned back to the learned State counsel.
